“What to do if a very close person betrayed you?”
Nikolai is a sailor who is at sea for about 8 months a year. Nikolai has (now had) a wife, they have been married for 20 years. The wife asked Nikolai to give her a house that Nikolai bought with his own money during the marriage. Nikolai fulfilled his wife’s request and gave her the house. Nikolai did not know that as a result of the gift, the house became the separate property of the wife, not subject to division in the event of a divorce. A year after receiving the gift, the wife kicked Nikolai out of the house that was given to her.
Nikolai contacted lawyer Bogdanov. Having examined the circumstances, the lawyer came to the conclusion that Nikolai’s rights were violated, that the wife, as the gifted one, showed gross ingratitude towards the donor. A lawsuit was filed in court for divorce and a lawsuit to revoke the gift. In connection with the wife’s attempt to encumber the house, another lawsuit was filed to invalidate the wife’s transaction.
To date, Nikolai’s marriage has been dissolved due to his wife’s violence against Nikolai, the court’s decision has entered into force; the wife’s transaction to encumber the house has been declared invalid by the court’s decision; the court’s decision imposed security on the house, preventing the wife from selling the house.
Lawyer Bogdanov: “There could be no ordinary solution in this case, and we used legal norms that lawyers usually forget about – we proved the wife’s violence against her husband. It is worth remembering that violence can be not only physical, but also psychological or economic, therefore, a sweet and “weak” woman can easily turn out to be the rapist in the family.”
In this dispute, the parties came to an agreement at the request of the wife. Needless to say, the terms of this agreement were beneficial to Nikolai?
Note: the client’s costs for the lawyer’s assistance are reimbursed to the client to a certain extent in the event of victory in the dispute.
